The taking on of conflicting interests by lawyers is not allowed as a result of the professional code of conduct (sec. 43a para. 4 BRAO). Prior to taking on a retainer, there is therefore always a check to see whether or not there is a conflict of interests.
In the case of disagreements between lawyers and their clients, upon application there is the possibility of out-of-court dispute settlement at the regional Chamber of Lawyers (in accordance with sec. 73 para. 2 no. 3 in conjunction with sec. 73 para. 5 BRAO) or at the arbitration board of the legal profession (sec. 191f BRAO) at the Federal Chamber of Lawyers, which can be found on the Internet at the Federal Chamber of Lawyers’ homepage (www.brak.de).
