Changes to the Romanian Labour Code

The long-debated and criticised changes to the Labour Code have been published on March 31, 2011 and will come into effect within 30 calendar days since publication, through Law 40/2011. Their declared aim is to foster flexibility in relations between employers and employees and to stimulate competitiveness. Much remains to be done and, arguably, many observers still view the Labour Code as heavily favouring the employee’s rights. Our note highlights some of the measures introduced, but we caution that due to its recent promulgation, it is unclear how several of the new provisions will be applied.
