Emmanuelle van den Broucke is a partner in Salans' Paris office. She specialises in competition and community law.

Since joining Salans, Emmanuelle has worked on numerous competition law issues: the analysis of merger, buy-out and joint venture agreements and, where necessary, notification to the French authorities and the European Comission. She assists and advises clients during proceedings for anti-competitive practices before the French Competition Authority and the French courts. She has also undertaken audits and helped several clients to put in place compliance programs. She has excellent knowledge of the pharmaceutical sector.

Emmanuelle has also developed thorough expertise in the French regulation of restrictive practices, advising clients on the negotiation and implementation of annual framework agreements and conditions of sale as well as on the compliance of their business practices with respect to the provisions of commercial law or specific regulations on certain products. She is regularly consulted in the setting-up of distribution agreements and assisting clients during their termination and with any subsequent litigation that may arise.

Emmanuelle is a member of the French Association of Lawyers in Competition Practice; she regularly publishes articles on competition law and is the editor of a monthly newsletter on competition issues.

Recent Experience:

  • Assisting an international car distribution in its notification to the European Comission of its joint venture with an international car manufacturer
  • Assisting one of the three main players in temporary employment services in a procedure before the French Competition Authority for alleged exchanges of information to limit competition on major accounts
  • Advising the French subsidiary of an American pharmaceutical company in a dispute before French courts for abusive and abrupt termination of a major distribution contract and for a judicial appraisal of damages
  • Assisting a toy maker in the proceedings before the French competition authorities for alleged price fixing practices between the producers and distributors
  • Advising Europe's second largest salmon procedure on its double acquisition of the market leader and the smallest market operator, especially during the Phase II merger control investigation before the French Competition Authority and during the negotiation of undertakings with the French Minister for the Economy
  • Defending a Parisian luxury hotel in proceedings for alleged illegal information exchanges before the Competition Authority and the Paris Court of Appeal
  • Conducting an in-depth antitrust audit of the French subsidiary of an leading European pharmaceutical group analysing the legality of its commercial practices regarding sales to pharmacies and hospitals
