Gérard Delile, a partner in the Paris office, practices in all areas of intellectual property law (trademarks, patents, designs, domain names, copyright, unfair competition and trade secrets), both as a litigator and in counseling. Gérard is also active in the fields of media and entertainment, licensing and technology transfers, press and advertising law, as well as in litigation and arbitration for IP and commercial law.

He is certified in France as a specialist in Intellectual Property Law (1994) and in International Relations Law (1994).

He has been recommended by Chambers as a “leading individual” in its 2006 and 2007 editions : “[Gérard Delile] has a broad practice which includes both hard and soft IP, and also appears in the more peripheral areas of technology transfer and licensing and advertising law. Peers pressed for his inclusion in the rankings, with one lawyer modestly declaring: "If I deserve to be in the tables, Gérard certainly should be!"”

Recent Experience:

  • Representing a major Canadian toy manufacturer in a seven-year trademark and unfair competition dispute against the world market leader over the right to freely reproduce parts of a famous game no longer protected by any IP or other proprietary right. This Supreme Court judgment is considered a landmark decision, and the case has set a precedent followed by several courts outside France, notably in Spain and in Germany (Supreme Court).
  • Representing a major international cigarette manufacturer in a trademark infringement and forfeiture suit in France against an internationally well-known German fashion designer and manufacturer, over the latter's brand which is already registered and used by the former as a trademark for cigarettes.
  • Representing a major European telecom operator in several patent infringement actions in France, including one relating to secured pay-TV technology.
  • Representing a leading French luxury goods manufacturer in a series of criminal trademark infringement actions concerning imported counterfeits withheld by the Customs authorities.
