James Davies is an associate in Salans' London office and a member of the firm's Global Employment Group.
James’ contentious work includes defending employment tribunal claims, including unfair dismissal and discrimination, and bringing and defending High Court proceedings, including the enforcement of restrictive covenants and bonus disputes. His non-contentious work includes drafting employment contracts and related documents, including bonus and employee share plans, advising on redundancies and restructurings and dealing with the employment aspects of corporate/commercial transactions, including acquisitions and the outsourcing of services, often with cross-border or multi-jurisdictional aspects.
James writes regularly for HR and in-house lawyer publications and has spoken at a number of internal and external seminars, particularly on TUPE and the employment aspects of insolvency.

Successfully defending a High Court breach of contract claim brought by the former Chief Economist of one of the world’s largest mining companies for failure to pay a contractual bonus during the ‘credit crunch’. Reported at: [2010] All ER (D) 235 and [2010] I.R.L.R. 976

Successfully defending a high value employment tribunal claim for unfair and wrongful dismissal, unlawful deduction from wages and discrimination and victimisation brought by the Sales Director of a media production company

Successfully defending a luxury clothing company in various employment tribunal and Employment Appeal Tribunal claims of unfair dismissal and race and sex discrimination

Coordinating the defence of claims (injunction proceedings in Romania and employment tribunal proceedings in England) on behalf of a global steelmaker and negotiating a multi-jurisdictional settlement agreement compromising claims under English, Canadian, and Romanian law
