Salans has extensive experience of contentious work with highly experienced practitioners who regularly engage in English High Court litigation as well as LMAA, LOF, FOSFA, GAFTA, LCIA & ICC arbitrations. London is the premier arbitration venue for the resolution of shipping and trading disputes. Our London office is well placed to obtain judgments and awards. Our global reach of 22 offices across both developed and emerging markets is useful for the successful enforcement of arbitration awards and court judgments.
On the litigation side, we work closely with owners and charterers and their P&I and defence clubs, charterers’ liability underwriters, hull and machinery underwriters and cargo insurers. We have access to a strong network of local correspondents worldwide, extending our reach even further into jurisdictions where we presently do not have our own full-service offices.
Our Experience
Our global client base includes substantial liner operators, ship managers, commodity traders, freight forwarders and hauliers in addition to ship-owners and charterers. A sample of work we have undertaken in this area includes:

New York: We are experienced in attachment and arrest of ships, aircraft, and bank accounts. We have dealt with the representation of a major Singapore and Chinese shipyard in connection with a contract dispute with a customer for an ocean going tug and drilling platform, including contract disputes, lien issues, and bankruptcy law issues;

Barcelona: We are experienced in litigation shipping matters such as vessel arrests and damage claims. Recently, in conjunction with our London office, we worked on a matter relating to different arrest releases in Huelva,for a client referred to us by a Norwegian law firm;

Istanbul: We represented a government institution in charge of all maritime activities in Turkey in connection with a dispute concerning a ship built by a Polish company. The Arbitration Rules of the London Chamber of Commerce have been implemented in the dispute;

Almaty: We represented a leading global cargo transporter and logistics manager in a dispute with the Customs authorities in Kazakhstan concerning errors in a tax assessment; and,

St. Petersburg: we represented a Danish company before the Russian court in the matter of enforcement of a Norwegian arbitral award in the dispute out of contract on shipbuilding. We have also represented a Western cargo owner before the Russian court in a dispute over allocation of salvage costs and enforcement of London arbitration awards.
